You can disable it by going to Mail » Preferences » Composing then in the 'Create Notes & To Do's in:' drop-down menu, select On My Mac.
Delete the Apple Mail To Do folder on the server and it shouldn't be created again :-)

But I think I'm even more annoyed at the fuckwads who post that "answer" about the checkbox. Sine half the damn internet says that, and its always followed by "no, doesn't work, it comes back", you'd think they'd stop speaking about shit they know nothing about
